When was the roof completed?

Roof was phase one, completed in 2018. Job file shows the whole job completed prior to 2020.
Clint's position
The permit was not even issued until August 27, 2018, and the city's final inspection did not pass until May 29, 2019, still noting corrections needed. Servpro's own $500 reimbursement check issued January 2020 shows the job was still closing out.

When does the warranty clock start?
Servpro / Wilpro says
From roof installation (2018) or at latest vendor final payment (August 2019); therefore the roof is 'older than 5 years' and outside warranty.
Clint's position
From completion of the entire job. Even using Servpro's own August 2019 final-payment date, the July 2024 claim falls inside the five-year window.

What caused the roof failure?
Servpro / Wilpro says
The report the homeowner supplied shows wind damage and a tree strike, which insurance paid for. Asks when leaking started; a defective roof would typically leak before five years.
Clint's position
Progressive's August 21, 2024 coverage letter states in writing that 'the policy does not cover for improper installation of your roof,' which is why Progressive paid only $627.56 of roofing (the tarped areas) out of a $5,239.07 net wind and tree payment and left the rest of the failing roof unpaid. Servpro's own on-site estimator Brian Wright immediately identified improper installation.

Was the problem reported in time?
Servpro / Wilpro says
No indication of any problem before July 2024.
Clint's position
The failure was reported the same month it was discovered: to the City of Carrollton on July 19, 2024, to Progressive when the claim opened, and to Servpro, whose Newnan office was repeatedly unresponsive to contact attempts. Even on Servpro's own August 2019 completion date, July 2024 falls inside the five-year warranty window.

Who should pay?

Insurance owes for wind and tree damage. Liability cannot be determined without a site inspection.
Clint's position
Insurance paid what it owed for wind, tree, and interior damage. The underlying improper installation is a workmanship issue that falls under Servpro's warranty on a $200,000 job.
